The Vienna Town Council advanced several sidewalk projects to a final engineering design phase last night (Monday), even as another project continues to draw strong opposition from residents on the affected street.

Nearly every resident on Alma Street Southeast has signed a petition opposing a proposed project to add a sidewalk on the even-numbered side of their street between Delano Drive SE and Follin Lane SE.

The town council authorized a contract with an engineering firm to conduct final design work on that project and three others on Oct. 11.

A petition objecting to the project has garnered signatures from 10 of 12 residences on the street as of Sunday (Oct. 31). Resident Matt Sanders, whose property is on the corner of Alma and Delano, said he thinks the remaining homeowners will both oppose it.

Sanders tried to speak before the council’s vote on Oct. 11, but in a brief exchange, Mayor Linda Colbert said it wasn’t a public hearing.

“None of the residents on Alma and Delano have asked for or desire sidewalks. In fact they oppose it,” Sanders said by email. “The council appears to be hell bent on spending this money and installing sidewalks whether their constituents want them. Just because this money is available, doesn’t mean it has to be spent ramming sidewalks down the throats of residents.”

Town Feels Urgency Over Trust Fund Deadline

The current wave of sidewalk projects, including the one on Alma Street, is part of a push by the Town of Vienna to speed up work on its Robinson Trust Sidewalk Initiative, which is intended to expand the town’s sidewalk network.

The initiative is funded by a $7 million charitable trust that former Councilmember Maud Robinson left after her death in 2019. Among other conditions, the trust money must be spent by fall 2024.

While several projects have moved forward this year, none have reached the construction stage yet, in part due to neighborhood opposition that evidently has not abated.

In addition to the Alma project, Sanders says his property will be affected by plans to add sidewalk on Delano Drive Southeast, from Echols Street to the end.

That project is among five that were approved for final engineering design yesterday:

  • DeSale Street Southwest from Moore Avenue to Tapawingo Road and also to the end of the street
  • Melody Lane Southwest from DeSale Street to Lullaby Lane
  • Tazewell Road Northwest from Lawyers Road to Holmes Drive
  • Orrin Street Southeast from Delano Drive to Follin Lane

The existing Locust Street Trail pedestrian bridge in Vienna

The Town of Vienna wants to give bicyclists access to a paved path that currently lets pedestrians cut past the Waters and Caffi ballfields behind the community center.

The Locust Street Trail improvement project would replace the narrow existing path with an 8-foot-wide, asphalt shared-use path from Center Street to the Washington & Old Dominion Trail, the Department of Public Works told the Vienna Town Council on Monday (Oct. 25).

Town staff pitched the project as part of a request to apply for more than $900,000 in funding from the Virginia Department of Transportation’s Transportation Alternatives program, which gives grants to local projects involving non-motorized travel and infrastructure improvements.

The town council unanimously approved the request, which included $766,439 for the Locust Street Trail project.

“I fully support this project,” Councilmember Chuck Anderson said. “It’s another important bike path in our town, which will allow people like me who go to the W&OD to turn right and get to Town Hall. Maybe I won’t drive so often.”

While this is the first time the project has been brought forward for possible funding, the Locust Street Trail improvements were recommended in the Maple Avenue Corridor Multimodal Transportation and Land Use Study that was completed in fall 2019.

The study said improving the path would give pedestrians and cyclists “a viable parallel alternative” to Maple Avenue and increased access to the W&OD Trail.

The study suggests extending the trail to Park Street at the mini traffic roundabout with Locust Street East, but that would require the town to acquire access to privately owned land, Director of Public Works Michael Gallagher says.

In addition to widening the path, the project calls for replacing the existing pedestrian bridge to the W&OD and addressing drainage issues. Right now, standing water renders the path unusable after a typical rainstorm, according to town staff.

The Freeman Store Bridge

The public works department is also reapplying for $155,772 from VDOT to construct a new pedestrian bridge to link the Freeman Store & Museum with the W&OD Trail.

That project has been in the works for five years now after water issues and general deterioration forced Vienna to remove the existing wooden bridge in 2016. The new bridge will be 52.5 feet long and consist of steel and timber, according to engineering plans.

According to Gallagher, the town is now seeking construction contractor bids for a third time. An initial solicitation received no responses, and during the second round, material costs, particularly for lumber, pushed the project over budget.

“We’re hopeful that we’ll get some good bids” this time, Gallagher said.

Vienna already has the Freeman Store bridge funding, but with the money set to expire this month, the town has to reapply to extend the deadline.

Staff initially planned to also request an extension of its VDOT funding for a project to complete the sidewalk on Park Street NE, but that was no longer necessary after they “just received word that that [deadline has] been administratively extended,” Gallagher said.

MetroWest residents no longer need to cross I-66 or Route 29 to grab a bite to eat.

With developers’ plans for retail south of the Vienna Metro station still pending, the first dining options in the mixed-use community come from a more unusual source: The Providence, a 154-unit assisted living and memory care facility that opened in March at 9490 Sprague Avenue.

While the facility’s casual dining-focused Wolf Trap Bistro & Lounge is currently only open to members, The Providence recently launched a fine-dining takeout program for the general public that it hopes to eventually turn into a full-fledged restaurant called Great Falls.

Available between 11 a.m. and 7 p.m. on Mondays through Fridays, the menu features salads, pizza, and sandwiches as well as more high-end entrées like beef filet, shrimp and mushroom marsala, and salmon with chimichurri rojo sauce.

“Creating this all-day menu was an option for us to not only give our members here…more restaurant-like type of food options, but also to incorporate in the restaurant project and have that be available to the public as well,” The Providence Dining Services Director Sabrine Marques told Tysons Reporter.

Previously the general manager of the now-closed PassionFish in Bethesda, Marques developed the Great Falls concept with Executive Director Annamarie Mariani-Huehn at the behest of Silverstone Senior Living and Watermark Retirement Communities, which respectively own and operate The Providence.

Juggling a publicly accessible restaurant with a private assisted living facility has brought a variety of challenges, from meeting state guidelines for both uses to developing a menu that’s affordable to The Providence members and fits their dietary requirements.

The team had hoped to open Great Falls by the end of this year, but that timeline proved impossible due to the additional complications introduced by the COVID-19 pandemic, including the supply chain and staffing issues that have upended retail and service industries across the country.

“I’d rather not do something that is not going to be the way we envisioned and wait until we’re actually ready to do that,” Marques said. “I mean, we want a fine dining experience for people that will be coming here the same way that we’re trying to provide that to our members who live here.”

Given that it serves an older population, bringing heightened COVID-19 risks, The Providence decided to initially limit food service to its residents and those living in The Atrium at MetroWest, which has condominiums for adults aged 55 and older.

When no issues arose, the facility rolled out the Great Falls menu to the public on Oct. 11 as the first phase of its project to establish a full restaurant.

Takeout orders for food and coffee can be placed by phone at 571-396-0500. Orders are made available via curbside pickup within 30-45 minutes, according to The Providence.

While slow at first, Marques says business has started to pick up, including from one neighbor who has already ordered takeout on three different occasions. She hopes the program will find a customer base not just in MetroWest, but also in the wider Fairfax and Vienna area.

“It’s definitely an exciting and challenging project that we have put in place,” she said. “We will continue to work towards [the restaurant], and we are hopeful that we can get that project up and running by next year.”

The Vienna Town Council approved increasing a contract yesterday (Monday) for construction on the police department’s new station.

The council agreed to allow up to $67,680 more in response to a “pre-construction design phase that took longer than expected and several unknown condition incidents that arose during construction,” according to a board item.

In January 2019, the town council approved a nearly $304,000 contract with construction management firm Downey & Scott with a 5% contingency of just over $15,000.

The firm reported that it had $64,456.24 in additional expenses. It broke down the costs in terms of staff pay, which ranges from $98.73 per hour for a construction inspector to $135 an hour for project executive Bill Downey.

It wasn’t immediately clear why the town council awarded over $3,000 more than what the company documented. A message seeking clarification from the Town of Vienna wasn’t immediately returned. A town official later wrote that the additional amount is a 5% contingency, allowing the town to address “additional unforeseen circumstances that arise in the construction process without having to go back to Council for approval.”

Police Chief Jim Morris said the increases were due to a soil issue, a gas line, and challenges on Center Street that he described them as unforeseen issues.

“All of those took Downey & Scott expertise and time to rectify,” Morris said. “Whether it be meeting with utilities, meeting with town council, meeting with town manager, they were heavily involved in rectifying those situations for us, on the town’s behalf.”

Downey said many of the changes were related to unforeseen soil conditions as well as relocating unmarked utilities.

A letter from the company said that over $30,000 of the increased expenses came from staff costs for Downey and project manager Kevin Fallin after requested changes from Vienna officials and COVID-19 disruptions added eight months to the project’s pre-construction phase.

The firm also reported $34,000 in staffing costs, plus $627 in mileage reimbursement, that were related to the re-alignment of a storm sewer at Center Street, design management, and other costs for a gas line relocation and soil issues.

Morris said the additional expenses could be paid with unused money in a 2018 capital improvement plan.

Prior to the funding approval, the project had $708,000 left in the town’s $1.1 million contingency fund, Fallin told the town council.

“Vertical construction is well underway, so a lot of the unknown conditions that we might typically encouter, we have surpassed that in terms of construction,” Fallin said regarding his confidence that the budget will stay within the contingency. “We feel good about where we are currently.”

Morris noted that contractors are currently calculating cost estimates for a proposed solar canopy and electric vehicle charging infrastructure, which could both be implemented as part of the project or as subsequent tasks.

Construction on the new police station at 215 Center Street South began in early 2021.

The Fairfax County Department of Transportation has extended the Oct. 18 deadline for its community survey on proposed changes to bus service in Centreville, Chantilly, Vienna, Tysons, and neighboring areas, including McLean and Falls Church.

The online survey, which is available in English and Spanish, will now be open until next Wednesday (Oct. 27).

Unveiled at virtual public meetings on Sept. 30 and Oct. 7, the preferred plan will enable Fairfax Connector to serve more people, reduce travel times, maintain more reliable schedules, and provide more access to key destinations in the area, according to FCDOT.

“We encourage people to take the survey so they can tell us what is most important to them in the preferred bus plan for the Centreville, Chantilly, Vienna and Tysons areas,” FCDOT Transit Planning Chief Michael Felschow said. “The service belongs to our riders and our goal is to make it dependable, convenient and on-time.”

Fairfax Connector launched its review last year as part of a broader effort to identify service improvements that could be made throughout the transit system. So far, the evaluation has also included looks at the Franconia-Springfield area as well as Reston and Herndon.

County officials initially presented three possible plans: one similar to existing service patterns, one that completely overhauled the service area, and a hybrid. The preferred plan now under consideration is the product of revisions based on community feedback.

The proposed plan encompasses 24 bus routes, including several involving the Tysons area:

  • Route 427 (North Tysons-Spring Hill): A new route between the Spring Hill Metro station and the McLean Governmental Center area, via Jones Branch Drive and Spring Hill Road
  • Route 468 (Vienna-Reston): A new route between the Vienna and future Reston Town Center Metro stations, via Lawyers and Soapstone roads
  • Route 660 (Centreville-Tysons): New, direct express service between the Centreville Park & Ride on Stone Road and the Tysons Metro station, via the Vienna station and I-495 Express Lanes
  • Route 662 (Centreville-Vienna): New off-peak and weekend service between the Centreville Park & Ride and the Vienna Metro station, via I-66
  • Route 671 (Chantilly-Vienna): New off-peak and weekend service with limited stops between Chantilly and the Vienna Metro station, via Route 50
  • Route 722 (McLean-Langley): A new express route between the McLean Metro station and Langley, via Route 123/Dolley Madison Boulevard

Some existing routes in the plan will have better connectivity or more frequent service, such as Route 467 between Dunn Loring and Tysons and Route 461, which travels in a loop through Vienna and Oakton.

Fairfax Connector is also studying a “flex service concept area” in Vienna and McLean northwest of Route 123 “as a way to provide future on-demand service to and from the four Metro Stations within Tysons,” according to a map showing the preferred plan’s peak service routes.

According to FCDOT, the preferred plan will shave about a minute off the average travel time within the review area compared to its existing Connector service. It will also put an additional 2,700 people within a quarter-mile of the bus system.

The changes will provide more service to population and job centers as well as minority communities and households with an income at or below $50,000, according to the county.

Compensation increases for employees and real estate tax cuts for residents are on the table, as the extra money keeps rolling in for the Town of Vienna.

In addition to receiving $8.5 million in federal COVID-19 relief funds this summer, the town ended the last fiscal year (July 1, 2020 to June 30, 2021) with $900,000 in surplus revenue, staff told the Vienna Town Council in a conference session on Monday (Oct. 18).

“We’re in this position because we cut our budget. We cut our revenues to deal with the pandemic. We had to cut our expenditures,” Finance Director Marion Serfass said. “But then our revenues came in in some key areas pretty darn close to what we had budgeted, so that gave us a nice surplus.”

According to town staff, Vienna got higher-than-expected revenue from sales taxes, business licenses, zoning permit fees, and state and federal revenues in FY 2020-2021. In addition, position vacancies helped keep costs down.

Vienna’s budget committee presented three options for allocating the surplus funds.

Scenario 1

The town could follow its traditional practice of putting half of any surplus in a rainy day fund and using the other half to cover currently unfunded priorities:

  • $125,000 to fix pay compression for 41 employees
  • $175,000 for street paving work
  • $50,000 for tree maintenance and beautification
  • $100,000 to address 2022 budget corrections

Scenario 2

Because the rainy day reserve is already above where it needs to be, town staff proposed instead “returning” some money to employees and taxpayers. If the town allocates all $900,000 in the current fiscal year, it could:

  • Cover the unfunded priorities above, except paving would get just $75,000
  • $280,000 to give residents a half-cent tax rebate
  • $270,000 to give employees a 3% salary increase starting on Jan. 1, 2022

Scenario 3

The town could also hold $550,000 to spend next fiscal year, while still covering the unfunded priorities now:

  • $280,000 to reduce the real estate tax rate by half a cent
  • $270,000 to increase employee salaries by 3% starting on July 1, 2022

Serfass noted that the surplus could be spent on any priorities, but she suggested paving and tree maintenance because the town council had previously floated those as areas that could use more money.

“Here’s some things that fall into the category of things we wanted to do but haven’t had enough money to do them,” she said. “We could always put more money in paving. We’re only getting the index of ‘fair’…We know we have issues with trees.”

The council gave its support for funding those needs as well as holding money for a tax rate reduction in July instead of an immediate rebate.

“I know it’s not much either way, but I think [a rate reduction] has more value than mailing somebody a pretty small check,” Councilmember Ed Somers said.

The council proved skeptical, however, when it came to the proposed 3% salary increase, since it would be a recurring expense paid for with a one-time surplus.

“If you are using long-term money for short-term gain, I have never seen that work,” Councilmember Steve Potter said, adding that he would be more comfortable offering bonuses or another incentive to help recruit and retain workers.

According to Michelle Crabtree, Vienna’s human resources director, other jurisidictions have seen some success in using bonuses to recruit employees, particularly police officers and commercially licensed drivers.

“We’ve had a high turnover in public works,” she said. “We’ve lost eight people this year, and seven of them said it was one hundred percent because they could find more money elsewhere.”

Noting that Vienna is hardly alone in having labor challenges, Councilmember Nisha Patel said she would support bonuses targeted toward the positions facing the biggest hiring and retention issues.

“If we have additional funds that can go to staff, maybe we should use those more wisely to attract and retain, as opposed to just spreading it out,” Patel said.

The Vienna Town Council will hold a public hearing on the surplus funds on Nov. 15.

A local chiropractic doctor recently surrendered his license after allegedly engaging in sexual misconduct with six patients.

The move came just under a year after the Virginia Board of Medicine voted to suspend Leroy Bazzarone’s license after he reportedly engaged in sexual contact or conduct that a reasonable patient would consider lewd or offensive.

A consent order from the board alleges that Bazzarone, who ran a chiropractic practice in the Vienna area, would provide services to receptionists for free and that he touched some of the women inappropriately when working with them.

The board’s doctors unanimously determined his actions were problematic and agreed on Sept. 2, 2020 to suspend his license following the incidents, which took place from 2013 to 2020.

“The Board determined that Dr. Bazzarone’s ability to practice constituted a substantial danger to the public health and safety and voted to summarily suspend his license,” meeting minutes said.

With a notary present, Bazzarone signed the consent order prepared by the board on Aug. 27, stating that he neither admitted nor denied its facts.

As part of the settlement, he waived his right to a formal hearing and his right to contest the report’s facts and legal conclusions in any future court or administrative proceeding involving the board.

For half of the patients involved, he had no record of treatment, and for others, he didn’t document all of the treatment he provided, according to the report.

Department of Health Professions spokesperson Diane Power said the settlement involves a permanent surrender of the license.

In a letter through an attorney to a Department of Health Professions investor, Bazzarone said he was retiring as of June 30, 2021. The board recorded his license as surrendered as of Sept. 1.

The reported behavior involved Bazzarone offering free treatment to women he employed as receptionists and massaging their breasts and genital areas. Sometimes, he removed their clothes or took off his own.

The Fairfax County Police Department said it has several reports involving Bazzarone on file.

According to Fairfax County General District Court records, he was arrested on Sept. 4, 2020 and charged with misdemeanor sexual battery for a Sept. 14, 2019 incident. He was found guilty and sentenced on March 11, 2021 to six months of jail. The prison sentence was suspended. Read More
